Supreme Court of India
Surendra Nath Singh (D) Through Lrs vs U.P.Secondary Edu.Service Commision … on 23 February, 2012
Bench: Dipak Misra, Dalveer Bhandari

IN THE SUPREME COURT OF INDIA
CIVIL APPELLATE JURISDICTION

CIVIL APPEAL NO. 2368 OF 2007

SURENDRA NATH SINGH (DEAD) THROUGH LRS. Appellant(s)
:VERSUS:

U.P. SECONDARY EDUCATION SERVICE
COMMISION & ORS. Respondent(s)

O R D E R
Learned senior counsel appearing on behalf if the appellant submits that unfortunately the appellant has died on 31.01.2010 and on the basis of the letter dated 6.11.2004 issued by the Manager of the School, the appellant has worked as a Principal from 1.7.1994 to 31.01.2010 but he has not been paid the salary of the post of Principal from 1.7.2004 to 31.1.2010. In case the appellant has worked as a Principal from 1.7.2004 to 31.1.2010, he would be entitled to the salary of that post.

We accordingly direct that the respondents, after making necessary enquiries and verification, shall make payment of salary of the post of Principal for the period 1.7.2004 to 31.1.2010, to the legal representatives of the appellant within a period of three months from today.

With these observations and directions, this appeal is disposed of, leaving the parties to bear their own costs.
